Morning Greatness: Flynn Judge Hits the Brakes, Allows Lefty Interests to Influence Dismissal

Good Wednesday morning.

Here is what’s on the president’s agenda today:

What fresh hell is this? Flynn judge stalls dismissal, opens up case to “friends of the court”

The judge in the Lt. Gen. Michael Flynn case has solicited friends of the court arguments, also known as amicus curiae, about whether he should grant the DoJ motion to dismiss. The action comes after the DoJ filed papers to drop the case following a review by 10-year FBI veteran and current U.S. attorney Jeffrey Jensen’s recommendation and A.G. Barr’s agreement. Judge Emmet G. Sullivan is dillydallying about dropping the case. He previously refused to allow amicus curiae. What the ****?

“Judge Sullivan, who denied leave to file amicus briefs when he knew third parties would have spoken favorably of Flynn, now solicits briefs critical of Flynn,” independent journalist Michael Cernovich wrote on Twitter Tuesday evening. “This is a violation of the judicial oath and applicable ethical rules. We will be filing a complaint against Sullivan. … [He] is acting as a politician, not a judge.”

Flynn’s legal team indicated in a filing Tuesday that a sealed amicus brief has already been submitted by a left-wing group known as the “Watergate Prosecutors,” urging Sullivan not to toss out Flynn’s guilty plea despite the Justice Department’s request. That group was featured in an October 2019 Washington Post opinion piece, and listed Jill Wine-Banks — who previously advanced unsubstantiated collusion theories involving the Trump campaign and Russia — as one of its members.

My good friend, Sean Davis wrote on Twitter that Judge Sullivan was letting “left-wing lawyers write his final order against Flynn for him.”

Indeed.

Democrats unveil $3T fantasy “relief” bill

Yesterday, the vacationing House Democrats released a monstrous and unserious Chinese virus “relief” bill. You can tell it’s unserious because they didn’t work with the Senate or any Republicans to craft it. If they wanted the bill to pass and if they wanted to provide relief to people they wouldn’t waste time on grandstanding DOA legislation, they would sit down with all the players and negotiate. Nancy knows this bill will not get the president’s signature or pass the Senate.Senate Majority leader declared the bill “dead on arrival.” He said, “What you’ve seen in the House [from] Nancy is not something designed to deal with reality, but designed to deal with aspirations. This is not a time for aspirational legislation, this is a time for practical response to the coronavirus pandemic,” McConnell said, referring to House Speaker Nancy Pelosi (D-Calif.).”

The House Democrats will fruitlessly vote on the bill on Friday. Here’s some of the goodies in the bill:

Provisions include another round of direct payments of up to $1,200 per person — including for each dependent child — up to $6,000 per family, according to a Democratic fact sheet.

The bill also proposes extending the $600-per-week federal boost in unemployment insurance payments through January 2021. The boost — intended to ensure laid off and furloughed workers get roughly 100 percent of their pre-crisis pay — currently runs through July.

The Democratic fact sheet says the bill includes almost $1 trillion for state and local governments. Republicans including President Trump have been wary of state bailouts.

The bill would create a $200 billion “heroes fund” giving hazard pay to medical workers and appropriate $75 billion for virus testing and contact tracing.

A $100 billion allocation would help cover rent payments and $75 billion would go toward mortgage assistance.

Additional items include a boost in food stamps payments expected to cost $10 billion, a $25 billion bailout for the Postal Service, $3.6 billion for state elections offices and $5.5 billion for expanding high-speed internet to libraries and homes. The bill also proposes new funds for the Census and health insurance programs.

The bill would give relief to wealthy residents of high-tax states like New York by waiving the $10,000 cap on the federal State and Local Tax (SALT) deduction for 2020 and 2021.

Other goodies include:

  • Inspector general protections
  • Mandatory masks on Amtrak
  • Provisions for pot businesses
  • Utility shut-offs
  • EPA study on pollution and health
  • Nursing home ‘strike teams’
  • Funding for the arts and humanities
  • Aid for meat and dairy industries

Looks like a blue wave is coming <snicker>

There were two special elections on Tuesday and in Wisconsin, “Republican Tom Tiffany, a Wisconsin state senator endorsed by President Trump, easily won a special congressional election Tuesday in the state’s heavily conservative, rural 7th Congressional District.”

Over in California, Democrat Katie Hill who resigned after she had an affair with one of her congressional staffers not to mention her “thruple” arrangement involving a campaign staffer when she was running for office, the Republican candidate is leading. “Mike Garcia, a former Navy fighter pilot endorsed by President Donald Trump, led in preliminary results from a special election north of Los Angeles.” Garcia is leading Democratic California state legislator Christy Smith by 55.9% to 44.1%. If Garcia pulls out a win, he will become the only House Republican from a district Hillary Clinton won in 2016 with more than 50% of the vote.

Fox News also reports that in the Nebraska primary, “Trump has already doubled his 2016 total in the Nebraska presidential primary.”
