Democrats on Tuesday filed a lawsuit in Washington, D.C. federal court to block President Donald Trump’s executive order protecting the integrity of U.S. elections.
The lawsuit, filed by longtime Democrat election lawyer Marc Elias for the Democratic National Committee (DNC) and Democrat minority leaders Senator Chuck Schumer (D-N.Y.) and Rep. Hakeem Jeffries (D-N.Y.), argues that Trump exceeded his authority by making commonsense changes to safeguard American elections.
Trump’s March 25 “Reserving And Protecting The Integrity of American Elections” order requires the strict enforcement of citizenship requirements for federal elections and aggressive prosecution of election crimes.
The E/O also seeks to improve the security of voting systems, enforce compliance with federal law, and prevent foreign interference and unlawful use of federal funds.
Finally, it ceases the implementation of a Biden Executive Order that was designed to turn the federal government into a partisan get out the vote machine for Democrats.
The Democrat party has leapt into action to stop these election integrity measures, arguing that the “radical changes” will disenfranchise eligible U.S. voters.
“The Executive Order seeks to impose radical changes on how Americans register to vote, cast a ballot, and participate in our democracy—all of which threaten to disenfranchise lawful voters and none of which is legal,” the lawsuit states.
The Democrats also argue in their lawsuit that the U.S. Constitution only empowers individual states and Congress to control how federal elections are conducted, rather than presidents who could change election rules to favor themselves.
“The Framers of our federal Constitution foresaw that self-interested and self- aggrandizing leaders might seek to corrupt our democratic system of government to expand and preserve their own power,” the lawsuit argues.
A separate lawsuit was filed Monday by several liberal groups, including the Campaign Legal Center and State Democracy Defenders Fund, which is led by Norm Eisen, a former Obama administration official who has waged an aggressive lawfare campaign against Trump.
A Justice Department spokesperson said, “The Department of Justice has vigorously defended President Trump’s executive actions, including the order to Preserve and Protect the Integrity of American Elections, and will continue to do so.”
