22 Democratic States Challenge Trump Executive Order Ending Birthright Citizenship

At least 22 different states, all with Democratic control of their respective governments, have filed a lawsuit against President Donald Trump’s executive order ending birthright citizenship in the United States.

ABC News reports that an initial lawsuit was filed on Monday by a coalition of 18 Democratic state attorneys general, alongside the cities of San Francisco and Washington, D.C. A separate lawsuit was filed by four more states later on the same day, demanding that a federal court halt any implementation or enforcement of the order.

In the original lawsuit, a joint statement was issued by the 18 attorneys general, falsely declaring that “the President has no authority to rewrite or nullify a constitutional amendment or duly enacted statute, nor is he empowered by any other source of law to limit who receives United States citizenship at birth.”

U.S. District Judge John Coughenour, an appointee of former President Ronald Reagan, scheduled a hearing for 10 AM on Thursday regarding the lawsuit filed by the four other states.

The order in question directs all federal agencies to stop issuing documents of citizenship to anyone born to illegal aliens, as well as aliens who are in the country on temporary visas if the father is not an American citizen or permanent resident.

The larger lawsuit points out that at least 150,000 illegal aliens would lose their citizenship as a result of the order.

“They will all be deportable,” the attorneys general declared, “and many will be stateless.”

The numerous legal challenges are expected to eventually make their way to the United States Supreme Court for a final verdict on its constitutionality. The order argues that the 14th Amendment has been misinterpreted for decades, allowing citizenship to be automatically granted to anyone who is simply born on American soil, even if their parents are illegals. The United States is one of the only first-world countries that follows such a broad requirement for automatic citizenship, as most European countries do not acknowledge citizenship for those born to illegal aliens.

  1. Eventually, SCOTUS will decide this. Meanwhile, I think the AGs need to find an individual, after February 19th, who is denied citizenship. I do not believe the States have standing on this matter since nothing happens to them directly regardless of how the Courts rule
