Amicus Brief Filed to Invalidate J6 Committee’s Case Against Bannon

An amicus brief has been filed by America First Legal (AFL) on behalf of House Administration Subcommittee on Oversight Chairman Barry Loudermilk (R-GA). The brief was filed in support of Stephen K. Bannon’s emergency stay application to the Supreme Court after Bannon asked the Court to delay his prison sentence that begins July 1.

The brief argues that the Jan 6 Select Committee was illegal and asks the Court to invalidate the Jan 6 Select Committee’s report against Steve Bannon and seeks his release pending further appeal of his convictions.

Rep. Loudermilk says the J6 Committee’s blatant non-compliance with House rules and resolutions governing its own procedures means that it was unlawfully constituted and that his brief will hold the committee accountable while nullifying their actions.


Loudermilk has argued that the J6 committee misled the American people and that their work was conducted outside the bounds of legitimacy.

His subcommittee has been investigating the numerous security failures leading up to and on January 6, 2021 as well as the creation, operation and results of the partisan J6 Select Committee.

In a statement shared by AFL, Loudermilk said:

“Over the past year and a half, my Subcommittee has uncovered concerning misconduct by the Democrats’ former January 6 Select Committee. They suppressed evidence, deleted key files, and intentionally misled Congress and the American people all in an effort to protect a preconceived narrative.

The Select Committee failed to comply with the rules governing its own procedures. Therefore, the prosecution of Mr. Bannon for failing to appear for a deposition is invalid, as is any criminal prosecution.”

Before filing the amicus brief on Wednesday, Loudermilk told the Daily Caller:

“We have resoundingly discovered that they were not completely truthful with the American people. They had little regard for House rules and no regard for transparency. They suppressed key pieces of evidence, cherry-picked evidence that supported their narrative, and played a 20 Million dollar blame-game to frame President Trump and Republicans.”
