Report: John Durham Taking Over John Huber’s Fruitless Clinton Foundation Review

U.S. Attorney John Durham has taken over aspects of U.S. Attorney John Huber’s notoriously unproductive investigation into the Clinton Foundation, Fox News reported on Thursday.

In November of 2017, Huber was tasked to evaluate “certain issues” involving the Obama-era Uranium One deal with Russia, and potential corruption related to the Clinton Foundation, but nothing ever came of it.

Former Attorney General Jeff Sessions also asked Huber to review the FBI’s handling of the Clinton email probe, including allegations that the Justice Department and FBI did not follow proper “policies or procedures.”

Huber’s inquiries reportedly ended in January of 2020 with no results.

The Department of Justice Inspector General in June of 2018 concluded its investigation of the FBI’s handling of the Clinton email probe, finding the FBI’s explanations for not taking immediate action after discovering the Weiner laptop in October 2016 to be “unpersuasive.” IG Michael Horowitz  also found that “in key moments, then FBI Director James Comey clearly departed from FBI and Department norms, and his decisions negatively impacted the perception of the FBI and the Department as fair administrators of justice.”

There is speculation that Durham is looking into the FBI’s deliberate suppression of damaging information about the Clinton Foundation found in Clinton’s emails in the Fall of 2016.

Former New York Rep. Anthony Weiner, the husband of top Clinton aide Huma Abedin, was under investigation for sex crimes involving underage girls.

The FBI official who found the emails Weiner’s laptop as part of that investigation, revealed for the first time this week that the FBI’s lack of response made him “uncomfortable” and that he was warned by his boss not to whistleblow or he would be prosecuted.

FBI agent John Robertson, who worked in its New York office’s child sex crimes unit, unearthed tens of thousands of Clinton emails in late September 2016, but top FBI leaders—including fired FBI Deputy Director Andrew McCabe, fired FBI agent Peter Strzok, and former FBI counterintelligence chief Bill Priestap—ignored the bombshell revelation for weeks after they were alerted.

“The crickets I was hearing was really making me uncomfortable because something was going to come down,” Robertson reportedly later told Justice Department investigators. “Why isn’t anybody here? Like, if I’m the supervisor of any [counterintelligence] squad … and I hear about this, I’m getting on with headquarters and saying, ‘Hey, some agent working child porn here may have [Hillary Clinton] emails. Get your ass on the phone, call [the case agent], and get a copy of that drive,’ because that’s how it should be. And that nobody reached out to me within, like, that night, I still to this day don’t understand what the hell went wrong.”

Finally, a month later, fired FBI Director James Comey wrote to Congress about the email discovery, disrupting the election and enraging Democrats.

Robertson wrote a “Letter to Self” in late October after an Oct. 19, 2016, meeting, during which he implored Assistant U.S. Attorney Amanda Kramer of the Southern District of New York to push FBI leadership to look at the thousands of emails he had unearthed.

“I have very deep misgivings about the institutional response of the FBI to the congressional investigation into the Hillary Clinton email matter. … Put simply: I don’t believe the handling of the material I have by the FBI is ethically or morally right. But my lawyer’s advice — that I simply put my SSA on notice should cover me — is that I have completed CYA [Cover Your Ass], and I have done so,” Robertson wrote. “Further, I was told by [Kramer] that should I ‘whistleblow,’ I will be prosecuted.”

Robertson wrote: “I possess — the FBI possesses — 20 times more emails than Comey testified to. … While Comey did not know at the time about what I have, people in the FBI do now, and as far as I know, we are being silent. … If I say or do nothing more, I am falling short ethically and morally. And later, I may be accused of being a Hillary Clinton hack because of the timing of all this. … But if I say something (i.e., whistleblow), I will lose my reputation, my career, and risk prosecution. I will also be accused of being a Donald Trump hack.”

He added that “nothing could be further from the truth” because “I am apolitical.”

Did Huber ever contact Robertson for an interview? It seems unlikely.

A DOJ source told Fox News Thursday that the Utah U.S. Attorney “has faced mounting criticism from the Justice Department and White House over his progress.”

“There are folks that are aware of the fact that Huber has not done much, and there has been criticism at the Justice Department and the White House,” the source said. “Folks that have been concerned about what he did or didn’t do, and many of them feel that Huber did not dig deep enough or work hard enough.”

The source added that many are “very concerned about why there hadn’t been more done.”

President Trump in June trashed Huber, calling him a “garbage disposal unit” for ending his investigation without charges.

According to Fox News, parts of Huber’s Clinton Foundation probe have now been incorporated in Durham’s investigation.

The New York Times on Thursday first reported that Durham has turned his attention toward the Clintons, seeking documents and interviews about how federal law enforcement officials handled an investigation into allegations of political corruption at the Clinton Foundation.

FBI agents in 2016 were denied permission to subpoena the Clinton Foundation because they supposedly didn’t have sufficient evidence to do so. But frustrated agents argued that they had plenty of evidence, including evidence that was captured on a wiretap in an unrelated investigation, according to the NYT.  At the time, former Mueller deputy Andrew Weissmann led the Fraud Section at the Department.

It is not clear whether Durham will be able to complete his investigation before the election, but Attorney General William Barr has not ruled out the possibility of additional criminal charges.

During an interview with NBC News last week, Barr would only say that there “could be” more charges coming, although he declined to say whether any charges would be announced prior to Election Day.
