Heading into 2018, but still flying below the national radar, the state of California is on a confrontation course with the federal government in Washington, D.C. Given that Washington is crawling with reporters—because, these days, there is apparently no news that somehow does not involve or concern Donald J. Trump—it might seem odd that you’re not reading about it every day. But here we are:
The acting director of U.S. Immigration and Customs Enforcement says politicians who run sanctuary cities should be charged with crimes. Thomas Homan said in an interview Tuesday with Fox News Channel’s Neil Cavuto that the Department of Justice needs to file charges against municipalities that don’t cooperate with federal immigration authorities and deny them funding. He also says politicians should be held “personally accountable” for crimes committed by people living in the U.S. illegally. Homan says, “We’ve got to start charging some of these politicians with crimes.”
What provoked this extraordinary statement is California’s open defiance of federal immigration law, embodied in the state’s becoming a “sanctuary” for illegal aliens as of January 1. Under the new state law, nowhere in California may police ask about an individual’s immigration status, nor may local authorities cooperate with federal officials on immigration enforcement.
Let’s be as clear about this as we possibly can: not since South Carolina fired on Fort Sumter, thus precipitating Southern secession and the Civil War, has any state of the Union so brazenly thumbed its nose at the federal government. (And not just on immigration; California also just became the largest state to legalize marijuana, setting up a separate but no less serious conflict with federal drug laws.) And, once again, it’s Democrats who are doing the thumbing.
The situation is rich in irony. Southern Democrats insisted they were acting constitutionally under the 10th Amendment by defying anti-slavery sentiment; Southern Democrats, after Lincoln was assassinated by one of their number, continued to wage a rear-guard action at the state level in the defeated South throughout the Andrew Johnson and Grant administrations; Southern Democrats continued to use the same argument during the Civil Rights movement to justify Jim Crow laws and the poll tax. It took not only acts of Congress to certify the plain outcome of the Civil War, but also a series of federal court decisions, backed up at times by troops.
Had Lincoln, and the country, dodged Booth’s bullet, there is a strong case to be made that he would have declared the Democratic Party a seditious organization and outlawed it—especially as Democrats demonstrated, through their postwar actions, that they had every intention of returning Lincoln’s “charity for all” of the second inaugural address, with malice toward him, the GOP, and the country at large.
Now California Democrats—as radical a group of anti-Americans as you will find in this country, whether legal or “undocumented”—have again fired on Fort Sumter. And once again (don’t kid yourselves), the goal is de facto and, later, de jure, secession from the United States of America, as part of the Aztlan-inspired Reconquista of what Hispanic radicals consider lost territory.
Never mind that California has been a state since 1850, and fought on the Union side in the Civil War. Never mind that California was settled by hard-working New Englanders and Midwesterners, who transformed it from a wilderness into the most prosperous and, later, largest, state in the Union. Never mind that, since the early 20th century, California has been the pot of gold at the end of the American rainbow, where both winners and losers went to seek their fortunes. The Mexicans, who failed to settle the territory properly in the first place, now want it back.
There’s another major irony at work here. When I was a boy, growing up in San Diego in the 1950s and early ‘60s, the governor of the state—then at its apogee—was Edmund G. “Pat” Brown, an affable Irish-Catholic Democrat who governed at first within the consensus of California political sentiment at the time, building infrastructure and raising the profile and quality of the University of California. Politically, Brown leaned to the left, to be sure, but was otherwise unremarkable, having followed the Republican Goodwin “Goody” Knight into office; it was only after his second term, after he’d radicalized and the state had begun to deteriorate, that he was defeated by Ronald Reagan.
Now the governor of California (as he was during my years in San Francisco in the late 1970s and early ’80s; and as he is again now, having nothing else to do) is Edmund G. Brown, Jr., better known as Jerry. Formerly a simply flaky novitiate who decided the priesthood would reduce his chances of dating Linda Ronstadt, Jerry has “evolved” into as hard a radical Leftist as you will find anywhere in office, living proof of the contemporary uselessness of a Jesuit education, and of the crushing guilt of certain members of the Irish Catholic community in America.
So now the feds are beefing up for battle with Jerry and his pro-illegal allies in Sacramento who passed the “California Values Act.”
Taking a jab at Gov. Jerry Brown, President Trump’s top immigration chief on Wednesday said he was preparing to “significantly increase” his agency’s enforcement presence in California because of last year’s passage of a landmark “sanctuary state” law.
“California better hold on tight,” Thomas Homan, acting director of U.S. Immigration and Customs Enforcement, said on Fox News. “They are about to see a lot more special agents, a lot more deportation officers.” The comments were the latest salvo between Trump immigration officials and California leaders over the law that took effect Jan. 1.
California has thus descended into a state of lawlessness masquerading as state law, and this will likely end about as well for the Golden State as the same shenanigans did for South Carolina in 1865. The Trump Administration, which is spoiling for this fight and will have it unless California backs down (which it won’t), is fixing to make an example of Brown. True, there doesn’t appear to be a man with the savvy and moral fiber of Ulysses S. Grant on the scene at the moment to enforce the Constitution—but in 1861, when war broke out, Grant was a retired Army officer struggling to operate a tanning business in Galena, Illinois. Three years later, he was the Lieutenant General in command of the entire Union army.
The issue of federal nullification was decisively settled by Lincoln, Grant, political will and force of arms. It’s to be hoped arms won’t be necessary to bring California and the renegade Democrats to heel, although a confrontation between, say, ICE agents and San Francisco cops could easily provoke it.
In the meantime, patriotic Californians might well consider a campaign of lawfare against “sanctuary” status:
- Now that the residents of the state have been effectively laid bare to criminal aliens, law-abiding Californians should demand that the state lower their property valuations for tax purposes, and renters should demand rebates, given the greater jeopardy legal Californians now face both in person and in property. Hurt the state where it counts: taxes.
- California federal taxpayers, who have been philosophically and practically disenfranchised as American citizens, and whose legal votes will now be nullified by an increasing number of illegals (who will soon enough demand and get the right to vote in American elections), should petition the federal government to reduce their federal tax liability until order is restored. What are they paying for?
- Class-action lawsuits should be filed against Brown, et al., for disenfranchising lawful U.S. persons from the national government. Let’s test the limits of elected-official liability, if and when another Kate Steinle case occurs—as it almost inevitably will. Did you hear about this one?:
The father of a man killed by an illegal immigrant is “furious” about California’s sanctuary state status and he’s putting up a fight. Don Rosenberg’s son, Drew Rosenberg, was on his motorcycle in San Francisco in 2010 when a man who was in the United States illegally struck and killed him, running over his body several times in an apparent attempt to flee the scene.
Roberto Galo, a Honduran national, was convicted of misdemeanor vehicular manslaughter, sentenced to six months in jail and ultimately deported in 2013. Rosenberg said he’s “furious” about California’s sanctuary policy, and he hopes President Donald Trump’s Justice Department will go after state and local officials who refuse to cooperate with federal immigration officials.
He revealed that he’s working on an initiative that would repeal California’s sanctuary state law and require law enforcement to cooperate with ICE (Immigration and Customs Enforcement). He encouraged people to visit fightsanctuarystate.com to donate or get involved.
The Left’s constant push to erode the legitimacy of the Constitution, which has been ongoing for decades, has now reached a critical stage. It’s time for pushback. As Lincoln said in his famous “house divided” speech of 1858, a nation cannot exist half-slave and half-free: “I do not expect the Union to be dissolved—I do not expect the house to fall—but I do expect it will cease to be divided. It will become all one thing or all the other.”
The solid-Democrat South wanted a slave state, and precipitated the bloodiest conflict in American history in order to get it. Today’s Democrats wish nothing less than to finish the job their forebears began in 1861: to destroy the United States of America as it’s existed since 1865.

Three years ago, my husband and I flew to San Diego to take a cruise to Hawaii. We stayed a few days before the cruise in the US Grant Hotel, which was the second time we stayed there.
We love that hotel and had no problems with Hispanics. What got me though, is when we took a tourist trolley over to “Old San Diego” where the city supposedly began. It seemed that the only language I heard being spoken was Spanish, with the exception of the shops where English, without accent, was spoken. I turned to my husband while walking around and asked him “What country are we in”?

Mr Walsh: Under no circumstances would Lincoln, (had he survived) moved against Democrats for treason. War and Unionist Democrats constituted at least half of Union generals, including Grant and Sherman. Unionist Democrats also gave Lincoln important indispensable political strength in border and western states. And then there’s this: He was even disinclined to prosecute the actual traitors—aboard the River Queen he famously gave Grant the wink and nod to let all Confederate leaders freedom to “disappear” over the border or ocean.
Grant was not a Democrat. But McClellan certainly was, and the Copperheads ran him against Lincoln in 1864. Anyway, who knows what Lincoln might have done had he not been murdered… by a Democrat?
Grant was a lifelong Democrat until he entered the Illinois militia in ‘61. He didn’t formally out himself as a Republican unto his first presidential run in ‘68.
His memoirs make it very clear where his political sympathies lay. Read them.

In the 1885 edition, Volume I, 215, Grant confirms his 1856 vote for Buchanan but beyond that, does not discuss his political position during the war. Anyone actually familiar with the Memoirs understands that it is the least political autobiography ever written by an ex-presiden and concludes with the war, which happened to be the least political period of Grant’s own life.

There is a move afoot in California to secede from the Union. Is there any way the people of the United States can vote on this. I think that we need to assist the Californians in their efforts. it wasn’t just slavery that the South was fighting. 90% of the tax revenues for the Federal Government were coming from the South and it was being spent in the North and in the Western expansion. THAT is what they were really pissed off about. It was Northern protectionism.
Slavery needed to end, don’t get me wrong. The South’s 1% wanted it, the churches were actually saying that it was “OK” but Virginia didn’t want anything to do with it seceding until Lincoln wanted Virginia to not only supply troops but let them cross their territory to get to S.C. which was a violation of the Militia Act of 1795 and other laws.
The final outcome of the Civll War was the end of slavery and its spreading to the territories (which I am relieved) but let’s stop the 9th grade oversimplification of the Civil War. It was a hell of a lot more complicated.

If you do not pretend that the Civil war was fought with the intent of FREEING THE SLAVES!!!! then the Union no longer holds the moral high ground. Mr. Walsh’s grasp of antebellum America appears rather loose. South Carolina didn’t fire on Fort Sumter until April, 1861; Texas had left the Union the previous February 1st, being the 7th and final State to secede prior to the bombardment. As there were only 11 States who officially did so, South Carolina’s cannons at Charleston cannot truthfully be said to have “precipitated” Southern secession. And the South wasn’t “solid-Democrat” before the War, either. Has Michael Walsh never heard of a “Cotton” Whig? Is he somehow unaware the Abe Lincoln he’s evidently so familiar with – who was a Whig – had a good friend in Congress, one Alexander Stephens of Georgia, who WAS one (Whig), before the War and his career as Vice-President of the Confederate States?
I really strongly suggest we need to figure out a way a better way to teach about the Civil War. It is complex but it never gets fleshed out. I didn’t know about the Whigs. Thank you for that.
As a Southern born and bred gentleman, I prefer to call what others call the Civil War the War of Northern Aggression.

In my family, we called it the War for Southern Independence. Either is more correct than “civil war”.
In a civil war, two or more factions strive for control of a government. The South had no desire to rule the North; they just wanted to be left alone.
You could also call it “War for Southern Independence” or the “Southern Rebellion” (even Sherman called it that) or the “late great unpleasantness”. But – be sure to pronounce it “Woah of Noathen Aggreshun” to rub it in further ;)
The Civil War was between Caesar and Pompei but I figure the Cali people would be confused.
Tennessee was like Virginia in that respect. After Fort Sumter, there was a referendum, and Tennesseans voted overwhelmingly to remain in the Union. After Lincoln called for troops to use arms against a sister state, one which had removed itself from association with the Union, TN held another referendum, and secession was approved.

Whenever I read articles dealing with American Justice, our laws, and the enforcement of it I get a slight queezy feeling. That is due to the fact that they lack credibility. It is due to a lack of enforcing laws we have illegals pouring into America all the way to Sanctuary cities.
I remember writing comments shocked that monuments can be ripped down with no permits allowing them to do that. I would comment that I cannot even urinate on one of these monuments without getting arrested if not ticketed and yet mobs tore down monuments and Trump did nothing.

This article certainly conflates a number of very different issues. Marijuana legalization and allowing free run to illegals are two totally different animals. One is a specifically assigned Constitutional duty of the U.S. Federal Gov’t; the other is not.
FYI – the author also seems to know little about the causes of the Civil War, and the many years a number of southern states petitioned for fair taxation and trade. Ya know, kinda like our founding fathers did 100 years prior.

Good article for me and many things I could say in response to it, but I’ll try to keep to just a couple.
– California population is unfairly being OVERrepresented in the U.S. Census. Illegals Are currently counted as state residents in the census, THIS POLICY NEEDS TO BE ENDED. This has significant downstream consequences. When they are included Calif gets additional House seats, additional Electoral votes in presidential elections, & additional federal funding. California politicians have conspired to commit this corrupt action. Where they fail to grow their legal native population, they succeed in importing illegals and falsely boost their population.
– No on secession. Many commenters flippantly agree to allow Calif to secede from the Union. We have to adamantly say NO. First, that question was answered with the Union victory in the War between the States. Secondly, Calif is a valuable economic part of our union. And thirdly, we can not allow a state gov’t to become corrupted and through these corrupt actions to cause good relations within our union to dissolve to the point that secession is seen as the solution to our disagreements.
You should read your US Constitution over again. Carefully. When you get around to doing that, notice that it rarely makes mention of citizens–usually it refers to persons. The US Constitution mandates a decennial census of persons. Well, kiddo, perhaps you mistakenly hold the belief that your “illegals” aren’t persons. Maybe you don’t consider them human. Easy fast solution. First enforce federal laws in California b using ICE or, if necessary, federal troops. While enforcing federal laws, cut off all federal funding for everything in California. (call it the bill for paying for law enforcement) Every penny. Next, prosecute all officials starting with the governor, and all of the legislators who voted for the sanctuary law. Lastly, prosecute all mayors and police chiefs who enforced the sanctuary laws.
I suspect that cutting off all federal monies will bring the leftists into line immediately.
Look at the efforts to close down crises pregnancy centers. If you are unfamiliar with what all these places do, look into it.
To me, this would be like trying to close down suicide hotlines because you think access to suicide is non-negotiable.
I was reading the Madison Wisc newspaper online. Madison is as leftwing as the most leftwing part of California, only much much more white. (white as Portland). But there must be a sizable hispanic population as the story was about the various hispanic groups getting together to defy President Trump and keep illegals in Madison. The thing that surprised me (but it shouldn’t) is how open the illegals are. And how the other Mexicans in Madison want open borders. The idea that we should have any border security at all is very offensive to these people.

You appear unfamiliar with the very law you cited. Jerry Brown hasn’t concealed or whatever any illegals. The illegals are right there for Trump’s ICE cops to see if they only go out and look. Gov. Brown is just not allowing the feds to commandeer California state resources for their own purposes. The feds can do their own job,* the feds’ own courts have ruled that the State of California may not enforce immigration laws on its own, so let the feds do it. Are you so unhappy that California’s state government has chosen to aggressively obey federal law as the feds’ own courts have interpreted it? If so, you have big, big problems.

He and the legislature are engaging in a conspiracy to keep the Federal authorities from finding illegal aliens in their state. They have been quite explicit about it.
They have never said in any of this that they just want to keep ICE from using California LE to do their jobs. It’s always been about keeping families together, etc.
The families could stay together if they hadn’t decide to illegally cross the border into a foreign country. They can stay together and go home. They are criminals. Period. They didn’t care about their family staying together when they decided to become criminals, we don’t care about it in prosecuting them. Anyone here illegally needs to leave. The entire mess was created by liberals promising sanctuary and dangling amnesty. They created the incentive. The broken families are their fault, and the fault of the criminals who believed them, not that of those who want the laws enforced.
When law enforcement fails, or is entirely absent, the people’s right to defend themselves remains. This particular problem doesn’t require light infantry militia units but would probably yield good results from an intelligence unit or two.
Can California have secret prisoners? If not (and I hope that it can’t) public inquiries as to prisoner identification can turn into to private requests for immigration status and for the feds to be waiting at the prison doors when an illegal immigrant is released.

California is in the process of surrendering to the Reconquista. The invasion of the USA since 1965 has produced many such areas but CA, as usual, leads them all. Use of force to keep the Union together will work as well as it did for Rome, the Austro-Hungarian Empire, and the Soviet Union. It will work in the short run but fail in the long run.

…is factually wrong. Before Fort Sumter was fired upon on 4 April 1861, there had already been seven secessions–SC, MS, FL, AL, GA, LA & TX.
Republicans are all about states rights and local rule until it’s progressive values a state wants. Suppose a majority of Californians want open borders? We already know a majority support marijuana. Why should the Feds come in and change the way Californians want California to be?
Or……Maybe it is time to recognize America is not one country. I think it is time to decentralize. Break up America in to 5 or 6 republics with home rule. Cali/Pacifica [CA, OR, WA] can be a socialist paradise, (with an economy larger than all but 5 countries) and the South came become a theocratic dictatorship under Lord Roy Moore.
Might want to think about supporting the State of Jefferson. There is a lot of support in the Northern Counties to form the 51st State of Jefferson and deal a huge blow to the liberals in Southern California. 21 Northern Rural California Counties only have 9 Representatives up against 111 Representatives for the rest of the state!
